When you have a Phase I ESA conducted and there is an environmental issue, it can often feel like the end of the road for your commercial real estate (CRE) deal. It's probably not. The typical first step when a Recognized Environmental Condition (REC) is discovered is a Phase II ESA. This involves sampling of site media (soil, groundwater, surface water, soil-gas, etc.) to determine if hazardous chemicals are present above state and federally established action levels. It sounds daunting, but it's really not rocket science (it's rock science).
